VOLUNTARY PARTICIPATION *

I acknowledge that I have voluntarily asked for assistance to have my vehicle extracted and/or moved by a volunteer of 775 Offroad & Recovery. I understand that 775 Offroad & Recovery is not a towing service or professional vehicle recovery experts, but just volunteers. I acknowledge that I assume ALL risks, including total loss of property or injury to myself up to and including death. I agree to hold 775 Offroad & Recovery, Officers, Voting Members, Volunteers harmless and free of any liability. I understand that if I don’t agree, I will not receive assistance. I also understand and agree that my vehicle may already be a total loss and am requesting 775 Offroad & Recovery to extract and/or move the vehicle to preserve the natural condition of the land. Allowing assistance is confirmation of agreement to this release of liability. I certify and understand that I can revoke assistance at anytime.

ACKNOWLEDGEMENT OF RISK *

I am aware that the use of winches, straps, hooks, vehicles and other tools can cause injury and that extracting and/or moving a vehicle is a hazardous activity. I acknowledge that my participation and acceptance of assistance entails known and unanticipated risks which could result in physical or emotion injury, paralysis, death, damage to property or third parties. The risks include, among other things: damage to property, total loss of property, unidentified damage to property, injury or loss of eyesight, inhalation or contact with airborne contaminates or flying debris, falls that can result in injury or death, tripping, injury or death from the result of falling or moving objects. Furthermore, I acknowledge that 775 Offroad & Recovery volunteers have difficult tasks to perform. I am aware that they do not intend to cause any damage or risk to others, however they seek and demand safety but they are not infallible. They might be ignorant of my fitness, cognitive abilities or medical conditions. They may give inadequate warnings or instructions, and the equipment being used may malfunction. I understand that such risks simply cannot be eliminated. Some landscapes have uneven ground that could be hazardous and also cause injury. My participation and acceptance in receiving assistance is purely voluntary, and I elect to participate in spite of the risks. I expressly agree and promise to accept and assume responsibility for all of the risks existing in this activity and certify and verify these statements by placing my initials here.

HOLD HARMLESS *

I agree to indemnify and hold harmless 775 Offroad & Recovery, any of its affiliated individuals and organizations, heirs, successors, assigns, agents, representatives, officers, directors, employees, contractors, attorneys, insurers or otherwise, no matter how described or designated and without limitation, from any and all actions, suites, claims, demands, attachments, damages, expenses, harm or destruction, suffered or accrued by or through me or anyone else which may result in any manner from my request for assistance, vehicle or other props, or otherwise pertained to the use of the above listed premises, or by the services provided by 775 Offroad & Recovery, and its heirs, successors, assigns agents, representatives, officers, directors, employees, contractors, attorneys, insurers or otherwise. Should 775 Offroad & Recovery, its affiliated individuals or organizations, heirs, successors, assigns, agents, representatives, officers, directors, employees, contractors, attorneys, insurers or otherwise no matter how described or designated, or anyone acting on their behalf, incur attorney’s fees and costs to enforce this agreement, I agree to fully and completely indemnify and hold them harmless for all such fees and costs. I fully understand, have had all of my questions fully answered to my satisfaction, agree with, and certify and verify these statements by placing me initials here.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND 775 OFFROAD & RECOVERY, AND ITS AFFILITATE INDIVIDUALS AND/OR ORGANIZATIONS AND OTHERS AS SET FORTH HEREIN. I SIGN IT OF MY OWN FREE WILL AND AGREE ON BEHALF OF MYSELF AND ALL OTHERS WHO MAY CLAIM BY AND/OR THROUGH ME TO BE BOUND AT ALL TIMES BY ITS TERMS.
